SHC Declares Marriage Gifts to Wife as Non-Returnable
The Sindh High Court (SHC) has upheld a pivotal ruling, declaring that gifts given to a wife at the time of marriage or before separation cannot be reclaimed.
The case was brought before the court by Arshad Jameel, who sought the return of gifts he had given to his wife. Justice of the SHC reviewed the petition and reaffirmed the trial court’s verdict, stating that such gifts are considered the wife’s personal property.
The detailed verdict emphasized, “The gifts given to the wife at the time of marriage or before separation become her personal property and cannot be reclaimed.”
This ruling reinforces the notion that marital gifts are irrevocable and belong solely to the wife, providing clarity and protection for personal property rights within marriages.
